(EB-1B)
Permanent Residency through Outstanding
Professors and Researchers
The second subcategory of EB-1 priority
workers is outstanding professors and researchers
who are internationally recognized for their
outstanding achievements.
Basic Requirements
- Be internationally recognized as outstanding
in a specific academic field;
- Have a minimum of three years of experience
in teaching and/or research in that field;
and
- Enter the U.S. in a tenure or tenure-track
teaching or comparable research position
at university or other institution of
higher education, or in a comparable research
position with a private employer under
certain circumstances.
Standards
The outstanding professor or researcher
must satisfy at least two of the following
criteria:
(1) Receipt of major prizes or awards
for outstanding achievement;
(2) Membership in associations that require
outstanding achievements;
(3) Published material about you in major
publications;
(4) Participation as a judge of the work
of others in the same or allied field;
(5) Original scientific or scholarly research
contributions to your field; or
(6) Authorship of scholarly books or articles
in scholarly journals with
international circulation in your field.
Application Procedures
No labor certification application is required.
However, unlike EB-1 worker of extraordinary
ability, the outstanding professor or researcher
cannot petition for himself or herself,
the employer must file the petition. If
the professor or researcher changes employers,
then a new petition must be filed by the
new employer.

three-step application procedures:
Case Evaluation
We usually provide you with a brief evaluation
over the phone to determine if your qualification
generally fits this category. If we believe
your qualification meets the basic requirements
of EB-1B, we will e-mail you an Evaluation
Packet for you to complete. Your case will
be presented at our firm’s Evaluation
Meeting for assessment. Our attorney will
then call you to go through the details
of the evaluation and assess the probability
of approval of your case.
Preparing Application
(1)You shall provide our firm with information
and copies of documentation
according to our Information List.
(2) We will help you draft testimonial letters
supporting the contention that you are
outstanding professor or researcher in your
field;
(3) We prepare petition forms and most importantly
the petition letter that contains detailed
legal analysis of your case to convince
USCIS that you are qualified for permanent
residency through Outstanding Professors
and Researchers.
(4) We send the entire case to you and your
employer for your review and signature.
Filing Application
(1)We will file your petition with USCIS
office having jurisdiction over your case.
(2) Upon approval of your EB-1 petition,
we will help you to obtain permanent residence
through either adjustment of status inside
the U.S. or consular processing overseas.
(3) We will assist you in making decisions
whether to file your petition concurrently
with your adjustment of status application.
